By visiting or buying from evrlybeauty.com (the "Site"), you agree to these Terms. If you do not agree, please do not use the Site.

1. Professional-use products

EVRLY adhesives, removers, primers and related products are made for use by trained, licensed lash professionals only. They are not for self-application. You are responsible for using products according to your training, applicable law, the label and the product's Safety Data Sheet (SDS), including patch testing and proper ventilation. Keep products out of the reach of children and use them only as directed. If you are not a trained professional, please do not buy or use these products.

2. Orders and pricing

• All orders are subject to acceptance and availability. We may refuse or cancel an order (for example for suspected fraud, a pricing error or a stock problem) and will refund any payment taken for a cancelled order.
• Prices are in U.S. dollars and may change without notice. Taxes and shipping are shown at checkout.

3. Shipping

We ship to the address you provide. Free shipping on U.S. orders of $100 or more; $4.95 flat rate on U.S. orders under $100. We ship internationally. International shipping rates and times are shown at checkout. You are responsible for any customs duties, taxes and import fees charged by your country, and we cannot control customs delays. Delivery dates are estimates, not guarantees, and we are not responsible for carrier delays.

4. Returns and refunds

You may return unopened, unused products within 30 days of delivery for a refund of the purchase price. You pay return shipping unless the product is defective or we sent the wrong item. For defective products, contact us within 30 days with photos and your order number, and we will replace or refund the item. Opened or used adhesives, removers and primers cannot be returned unless defective. Refunds go to the original payment method, usually within 3–5 business days after we receive the return. 5. Product information and results

We try to describe products accurately, but specifications and performance (such as dry time and retention) vary with humidity, temperature, technique and storage. Results vary. Information on the Site is general guidance and is not a promise of specific results. Store adhesive as directed and do not use products past their stated shelf life or expiration date.

6. Marketing emails and texts

If you sign up for marketing messages, the terms in our Privacy Policy apply, including that consent is not a condition of purchase, message and data rates may apply, and you can reply STOP to end texts or use the unsubscribe link in emails.

7. Discount codes and promotions

Discount codes are limited to the terms shown with the offer. For example, the welcome code gives 10% off a first order for new customers who have signed up for our marketing emails and texts, and may be used once per customer. Codes cannot be combined with other offers unless stated, have no cash value, and may be changed or ended at any time. We may refuse a code used outside its terms.

8. Reviews and content you send us

If you submit a review, photo or other content, you give us a non-exclusive, royalty-free right to use, display and share it in connection with EVRLY (for example on our Site and social media). You confirm you own the content or have permission to share it and that it is truthful. We may remove content at our discretion. If you received a free product or discount in exchange for a review, you agree to say so.

9. Intellectual property

The EVRLY name and logo, product names, text, photos and videos on the Site belong to EVRLY Enterprises LLC or its licensors. Please do not copy or use them without our written permission.

10. Disclaimer of warranties

To the fullest extent allowed by law, the Site and products are provided "as is" and "as available," and we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some laws do not allow certain disclaimers, so some of this may not apply to you. Nothing in these Terms limits any right you have under applicable consumer-protection law that cannot be waived.

11. Limitation of liability

To the fullest extent allowed by law, EVRLY and its owners, employees and suppliers are not liable for indirect, incidental, special or consequential damages, or for lost profits, arising from your use of the Site or products, including any claim arising from improper use. Our total liability for any claim relating to a purchase will not exceed the amount you paid for that purchase. Nothing here limits liability that cannot be limited by law, including liability for fraud or willful misconduct.

12. Your responsibility

To the extent permitted by law, you agree to defend and hold EVRLY harmless from claims arising from your misuse of products, your violation of these Terms or applicable law, or content you submit.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Los Angeles County, California, unless the law requires otherwise.

14. Changes to these Terms

We may update these Terms from time to time. The "Effective date" shows the latest version. Continued use of the Site after changes means you accept them.
